The short version
- You tell us what you want to find out. We write the questions, find the people, and send you the results with what we’d do next.
- Nothing goes live until you approve the questions, and we give you a delivery date before you pay.
- The people who answer choose to take part. Results describe them, not everyone in the country, unless we agree otherwise in writing.
- You get aggregated results only. You never get the identity of anyone who answered.
- Prices are in Australian dollars (AUD) for Australia and US dollars (USD) for the United States, as shown when you choose your market. Monthly plans renew each month until you cancel, and you can cancel anytime.
- If something goes wrong, our liability is limited to what you paid for the study or plan concerned.
1. Who we are
MANDA Survey is run by Mathew Madel, trading as MANDA OS, Sydney, Australia.
- ABN (Australian Business Number): [TO FILL: ABN]
- Street address: [TO FILL: street address]
- Email: [TO FILL: contact email]
“We”, “us” and “our” mean Mathew Madel, trading as MANDA OS. “You” means the business that buys research from us. The person who accepts these terms for a business confirms they’re allowed to do so.
2. What we sell
We sell the packages described on our website, at the prices shown there when you order, or as we confirm with you in writing (email counts):
- Survey packages (Market Check and Deep Study): we write a survey from your brief, collect answers, and deliver charts, findings and recommendations.
- Quick Poll: 1 to 3 questions put to adults in your market or a simple target group, with a results chart and a one-page summary.
- Poll widget: a poll box for your website, or a link for social media, with live results.
- Tracking poll: the same 1 to 3 questions asked again each wave, with a trend chart.
- Small Business Pulse: a monthly report on what customers tell our weekly MANDA Poll. The first issue goes out once our weekly polls have enough answers.
The number of questions and answers, and what each report includes, are as described on our website for that package.
3. How a study works
- You tell us what you want to find out and who you want to hear from.
- We write neutral questions and send them to you. Your study goes live once you approve them.
- Before you pay, we give you a delivery date for your results.
- We reach people through research panels, targeted ads, links and QR codes, and through any link you share with your own customers.
- We count one answer per person and check answers before they count.
- We send you the results, and what we’d do next, in plain English.
4. What research can and can’t tell you
- The people who answer choose to take part. Unless we agree otherwise in writing, the results describe the people who answered. They aren’t a random sample of the population.
- All survey results have a margin of error, and small groups within the results are less reliable than the whole.
- We tell you about any limits we know of, such as a group that was hard to reach.
- Our recommendations are our honest reading of the results. The decisions are yours, and we don’t promise any business outcome.
5. Your responsibilities
- Anything you give us to ask or show people must be lawful, truthful and not misleading, and you must have the right to let us use it.
- Don’t ask us to collect sensitive information unless we’ve agreed to it in writing first. That includes health conditions, disability, sexual orientation or gender identity, genetic or biometric data, precise location, government ID numbers, and anything about children. We may decline a question.
- Don’t ask us to identify anyone who answered, and don’t try to work out who they are from the results.
- Don’t use a study to sell or market to the people who answer it. Research and selling stay separate.
- If you quote results in public, describe them accurately, including how many people answered and when.
6. Who owns what
- You own your brief, your questions, and the report we deliver to you once it’s paid for.
- We keep our methods, templates and software.
- We may keep de-identified, aggregated results (never anyone’s identity) and use them for benchmarks and our own research, such as the Small Business Pulse. We won’t name your business or publish your study’s results without your permission.
7. How we handle answers
- Answers are stored by MANDA OS with our database provider, on servers in Seoul, South Korea.
- You receive results in aggregate only: totals, charts and themes, and written comments with anything that identifies a person removed. Where a package includes a data file, it holds results in that same form, never anyone’s name, contact details or panel ID.
- We take reasonable measures to make sure de-identified data can’t be linked to a person. We publicly commit not to try to re-identify it, and we require anyone we share it with, including you, to make the same commitment. By accepting these terms you agree not to try to re-identify anyone from your results.
- Everyone who answers must be 18 or over.
- Our Privacy Policy explains what we collect and why.
8. Prices, payment and taxes
- Prices are in Australian dollars (AUD) for Australia and US dollars (USD) for the United States. The price for your study or plan is the one we confirm with you before you pay.
- Online checkout isn’t open yet. Until it is, we confirm the details and the price by email, and nothing is charged until you’ve agreed to them.
- When checkout opens, card payments will be processed by Stripe. We may also send you an invoice.
- If any tax applies to your purchase, we’ll show it before you pay.
- Your bank may charge its own fees, such as for currency conversion. Those are yours to pay.
9. Monthly plans
The Small Business Pulse, the Poll widget and the Tracking poll are monthly plans.
- They’re charged monthly in advance and renew automatically each month until you cancel.
- Before you subscribe, we’ll show you the price, how often you’ll be charged and how to cancel, and we’ll ask you to agree to the automatic renewal separately.
- You can cancel anytime by emailing us. Once online checkout opens, you’ll also be able to cancel online, from a link in every receipt. Cancelling stops future charges.
- We’ll tell you at least 30 days before a price change takes effect, so you can cancel first if you want to.
10. Refunds
Our Refund Policy explains when you get your money back, including for late studies, studies with fewer answers than promised, and monthly plans.
11. Limits on our liability
- As far as the law allows, our total liability for any claim connected with a study or plan is limited to the fees you paid us for that study or plan.
- We aren’t liable for indirect or consequential losses, such as lost profits, or for decisions you make based on the results.
- Nothing in these terms limits any liability or right that the law doesn’t allow to be limited.
12. Stopping a study
We may decline or stop a study that breaks these terms or the law. If we stop a study for any other reason, we’ll refund what we haven’t delivered.
13. Governing law and disputes
If you have a problem, please email us first and we’ll try to put it right within 30 days.
These terms are governed by the laws of New South Wales, Australia, and its courts can hear any dispute. [TO CONFIRM with a lawyer: governing law and venue for customers outside Australia]
14. Changes to these terms
We may update these terms. The date at the top shows when they last changed. A change doesn’t apply to a study you’ve already paid for. For monthly plans, we’ll email you at least 30 days before a change takes effect.
